SMS TERMS & CONDITIONS

These SMS Terms & Conditions ("SMS Terms") govern your participation in the La Crema Caffe promotions through our promotional SMS messaging program.
By voluntarily providing your mobile telephone number and expressly opting in to receive promotional text messages from La Crema Caffe, you agree to these SMS Terms and our Privacy Policy.
1. ABOUT THE PROGRAM
The La Crema Caffe SMS promotional program delivers subscribers exciting text message marketing related to La Crema Caffe.
Messages may include:

- Technical problems;
- Service-provider limitations; or
- Other circumstances outside La Crema Caffe's reasonable control.
10. CHANGES TO THE SMS PROGRAM
La Crema Caffe may change, suspend, or terminate the SMS promotional program at any time, subject to applicable law.
We may change the frequency, content, format, or types of promotional messages sent through the program.
If the program is terminated, no further promotional SMS messages will be sent through the program except where otherwise permitted by law.
11. YOUR MOBILE NUMBER
You are responsible for providing an accurate mobile telephone number.
If your telephone number changes, you should update your subscription information or contact us so that your old number can be removed from our promotional SMS list.
You should not subscribe using another person's mobile telephone number without their authorization.
12. PRIVACY
Your participation in the SMS program is subject to our Privacy Policy.
We may collect and retain information relating to your SMS subscription, including your mobile telephone number, consent information, subscription date, method of consent, and unsubscribe requests.
We use this information to administer the SMS program, send promotional messages where consent has been obtained, maintain records of consent, process unsubscribe requests, and comply with applicable legal requirements.
We do not sell or rent our SMS subscriber list.
We do not provide our customer phone-number list to unrelated businesses for their own marketing purposes.

13. THIRD-PARTY SMS PROVIDER
La Crema Caffe uses Textmagic as a third-party SMS service provider.
Your mobile telephone number and information necessary to operate the SMS promotional program may be processed through Textmagic and other service providers used to deliver SMS communications.
Third-party service providers may process information outside Ontario or Canada, and information may therefore be subject to the laws of the jurisdictions in which those providers operate.
14. COMPLIANCE WITH CANADIAN ANTI-SPAM LAW
La Crema Caffe intends to operate its promotional SMS program in accordance with Canada's Anti-Spam Legislation ("CASL") and other applicable laws.
Commercial SMS messages may be subject to requirements relating to:
- Consent;
- Sender identification;
- Contact information; and
- Unsubscribe mechanisms.
La Crema Caffe maintains records relating to SMS consent and unsubscribe requests as part of its compliance practices.

17. CHANGES TO THESE TERMS
